Rental Agreement & Service Contract.

By booking services or renting items from Four Kees Events and Rentals(“ FKER”), the Client agrees to the terms and conditions outlined in this document. This agreement becomes binding upon the Client’s acceptance of these terms — either (a) electronically, via FKER’s online order confirmation page, which records the Client’s typed signature, timestamp, and IP address as a legally valid signature under the US ESIGN Act and the Massachusetts Uniform Electronic Transactions Act; or (b) in writing, via a signed copy of this document. All rental items remain the sole property of FKER at all times.
FKER’s countersignature is applied electronically at the moment of the Client’s acceptance, executed by an authorized officer of Four Kees Events and Rentalspursuant to a standing authorization recorded by FKER. The bilateral agreement is recorded with matching timestamps and is produced in full on FKER’s order confirmation page and in the generated signed agreement PDF.
Retainer.A non-refundable retainer of 20% of the total order amount, or $100, whichever is greater, is due upon order confirmation. Payment of the retainer secures the Client’s event date and is earned by FKER upon receipt as consideration for reserving the date and blocking the items from other bookings. The retainer is applied as credit toward the Client’s total balance.
Balance. The remaining balance is due no later than 1 week before the event date, unless otherwise agreed in writing.
Accepted methods. PayPal, Zelle, Cash App, cash, or check. Returned checks are subject to a $35 fee. Please include the order number (e.g. FKER-1042) in the payment memo so we can match payment to the event.
The Client’s reservation is confirmed once FKER verifies item availability AND the retainer has been received. Items are formally reserved for the event once the retainer is paid; the event is fully secured once the balance has been received.
Additional items or services requested after the initial booking are subject to availability and must be paid for before the event date.
The retainer is non-refundable in all cases — it is earned upon payment as consideration for FKER reserving the Client’s date.
Refunds apply only to balance payments received, processed to the original payment method within 14 business days:
Rescheduling is permitted once, subject to availability, at no additional charge if requested at least 14 days in advance. Subsequent reschedules may incur a $50 rebooking fee. Weather-related cancellations initiated by the Client are subject to this same schedule (see Section 6).
For outdoor events, the Client is responsible for providing adequate shelter (tents, canopies) for rented items. FKER is not liable for damage to items caused by rain, wind, extreme heat, or other weather conditions. If severe weather makes delivery or setup unsafe, FKER may postpone or cancel delivery and will work with the Client to reschedule at no penalty. Weather-related cancellations initiated by the Client are subject to the standard cancellation schedule in Section 3.
This agreement shall be governed by the laws of the Commonwealth of Massachusetts. Any disputes shall be resolved in the courts of Worcester County, Massachusetts.
